    What it is

    A home of its own, up a flight of stairs.

    A garage apartment is a second, smaller home built above a garage. Downstairs is still a garage. Upstairs is a place someone can live: a living area, a bedroom, a bath and some kind of kitchen, reached by its own stair.

    It gives the person living there more separation than any suite inside the house can. There's no shared wall, and a full floor of space sits between them and the driveway. It also uses the footprint you already have for parking, so it takes less of the yard than a separate cottage would.

    The trade is that it is a real building project. A second floor of living space needs a structure built to carry it, insulation and a vapor barrier between the cars and the bedroom, a stair that meets the code, and plumbing that has to find its way down to a drain.

    A typical garage apartment has

    Zoning

    What your town allows.

    New Jersey has no statewide ADU law. Each town writes its own zoning, and most have not written an accessory dwelling unit ordinance at all. In those towns, an apartment with a kitchen over a detached garage is a second dwelling the zone does not permit, and the route to it is a variance from the zoning board.

    Where a town does permit an accessory unit, its ordinance sets the terms: which zones, how big, whether the unit can be in a detached building, whether the owner has to live on the property, and parking.

    The building itself has rules too

    A garage is an accessory building, and zoning codes typically give accessory buildings their own limits: how tall, how close to the side and rear lot lines, and how much of the lot all your buildings together may cover. A second story is where garage apartments most often run into the height limit. Those numbers are different in every town and sometimes in every zone, which is why we read them for your address before any design work.

    Is a garage apartment an ADU in New Jersey?

    Usually, yes. An apartment over a garage, with a kitchen, a bath and a place to sleep, is a second dwelling on your lot, and that is what an accessory dwelling unit is in zoning terms. Whether you may build one depends on whether your town's ordinance permits an accessory unit and allows it in a garage or a detached building.

    Can I build a room over my garage without making it an apartment?

    Often, yes. A finished room with no kitchen, used as an office, a studio or a guest room, is generally treated as part of the house or as an accessory building rather than a second dwelling. Your town's height limit and setbacks still apply, and its rules for accessory buildings may limit what goes inside. We check both before we draw.

    Can my existing garage hold a second floor?

    Sometimes. Most garages were built to carry a roof, not a floor of living space with people and furniture in it. The footings, the walls and the slab have to be checked against the new load. If they fall short, the work grows to include reinforcing or rebuilding them, and at that point a new garage can make more sense.

    Can I rent out a garage apartment?

    Only where your town's ordinance permits an accessory dwelling unit, and under its conditions. Some towns require the owner to live on the property, some restrict who may live in the unit, and some allow accessory units only under an affordable-housing program.
